Revocable Living Trust

Everyone should have a living trust! A living trust (sometimes called a "revocable" trust) is a written legal document through which your assets are placed into a trust for your benefit during your lifetime and then transferred to designated beneficiaries at your death by your chosen representative, called a "successor trustee."

 

I have been doing this for my real estate clients for the last 25 years and I am opening the service up to anyone who needs to protect their property and valuables from creditors and others. This also insures your property will not go into probate upon your death.

With these documents, there is no need for an attorney. You simply fill in the documents with your information. You then get the documents notarized to make them legal. Then you need to keep them in a safe place and give a copy to beneficiaries and the successor trustee you will name in the trust document. The only document you will show to the bank or anyone needing verification that you have a trust is the one page "Certification of Trust".

 

I usually email these documents to clients and they fill them out and get them notarized. If you prefer, I can type your documents, print them out and email to you or you can pick them up.

 

You’ll fill in secure information such as your bank account information.

 

Don’t forget that the documents will need to be notarized to make them legal.

 

You can take them to your local notary (Postal Annex, UPS Store or other) or you can call a mobile notary to come out and notarize the documents for you. They usually charge a fee per signature. You’ll have one signature for the “Revocable Trust”, one signature for the “Certification of Trust” and one or more signatures for the “Quitclaim Deed” (which places your property into the trust name).

 

Very important! If you are doing a reverse mortgage, you need to close on the reverse mortgage first, then put your home in the “Revocable Living Trust” and send your lender the “Certification of Trust”.
